This Notice of Privacy Practices (“Notice” or “NPP”) describes how ReachLink (“we,” “our,” or “us”) may use and disclose your Protected Health Information (“PHI”) and how you can access this information.
This Notice is provided to you as required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations, as well as applicable state and federal laws.

OUR DUTIES UNDER HIPAA

We are legally required to:
  • Maintain the privacy and security of your PHI
  • Give you this Notice describing our legal duties and privacy practices
  • Notify you following a breach of unsecured PHI
  • Follow the terms of this Notice currently in effect

HOW WE MAY USE AND DISCLOSE YOUR PHI

We may use and disclose your PHI for the following purposes without your written authorization:

1. Treatment

To provide, coordinate, or manage your healthcare:
  • psychotherapy
  • evaluations
  • consultation with other clinicians
  • telehealth services
Example: Discussing your symptoms with a supervising clinician.

2. Payment

To bill and collect payment for services:
  • insurance claims
  • eligibility verification
  • preauthorization
  • billing statements

3. Healthcare Operations

For internal operations, quality improvement, audits, and training.
Examples:
  • Supervisor reviewing a clinician’s work
  • Quality assurance activities
  • Credentialing staff

4. Appointment Reminders & Communications

We may contact you regarding:
  • appointments
  • scheduling
  • care instructions

5. Required by Law

We may disclose PHI when required by federal, state, or local law.

6. Public Health & Safety

Including:
  • reporting abuse or neglect
  • preventing or reducing a serious threat to health or safety
  • disaster response

7. Health Oversight Activities

Audits, inspections, and licensure activities.

8. Judicial & Administrative Proceedings

Court orders, warrants, or subpoenas that meet HIPAA requirements.

9. Law Enforcement

Limited circumstances such as:
  • reporting certain injuries
  • complying with court-ordered processes

10. Research

Only with:
  • IRB approval, or
  • your written authorization

11. As Required By Government Agencies

Including national security authorities when legally mandated.

USES & DISCLOSURES REQUIRING YOUR WRITTEN AUTHORIZATION

We must obtain your written authorization for:
  • Most uses of psychotherapy notes
  • Marketing involving third-party payments
  • Sale of PHI
  • Any disclosure not described in this Notice
You may revoke your authorization at any time in writing.

SPECIAL PROTECTIONS: 42 CFR PART 2 (SUBSTANCE USE DISORDER RECORDS)

If you receive substance-use-related treatment or assessment, your records may be protected by 42 CFR Part 2, which provides stricter confidentiality rules than HIPAA.
This means:
  • We cannot disclose SUD treatment information without your signed written consent, except in limited cases such as:
    • medical emergencies
    • qualified audits
    • specific court orders
    • research
Any redisclosure of SUD information is prohibited unless permitted by Part 2.
A Part 2–compliant consent form will be provided when applicable.

YOUR RIGHTS REGARDING YOUR PHI

You have the following rights under HIPAA:

1. Right to Inspect and Obtain Copies

You may request copies of your PHI.
We will provide them in paper or electronic format.

2. Right to Request Restrictions

You may request limitations on our use or disclosure.
We are not required to agree, except when paying cash for services.

3. Right to Amend

You may request correction of inaccurate or incomplete information.

4. Right to an Accounting of Disclosures

You may request a list of certain disclosures made in the last 6 years.

5. Right to Request Confidential Communications

You may request communication via specific means (e.g., email only).

6. Right to Receive a Copy of This Notice

You may request a paper or email copy at any time.

7. Right to File a Complaint

You may file a complaint with:
  • ReachLink
  • U.S. Department of Health & Human Services (HHS)
We will not retaliate against you for filing a complaint.
